An Act made to provide for the settlement of suits, appeals and other proceedings which are unsettled and which have been filed on or before the date on which expires the period of the Suppression of Terrorist Offences Act, 1992 and for the conduct of cases and other proceedings on the basis of completed investigations and incidental matters

Whereas the period of the Suppression of Terrorist Offences Act, 1992 (Act No.44 of 1992) has expired on 21st Kartik, 1401/fifth November, 1994, respectively, in accordance with section 1 (2) of the said Act;

and whereas it is expedient to provide for the settlement of suits, appeals and other proceedings which are unsettled and which have been filed on or before the date of expiry of the said period and for the conduct of cases and other proceeding on the basis of completed investigations and for matters ancillary thereto;
Now, therefore, it is enacted as follows:-

1. Short title and commencement.- (1) This Act may be called the Suppression of Terrorist Offences (Special Provisions) Act, 1994.
(2) This Act shall come into force on the 15th Kartik, 1401/31st October, 1994, respectively.

2. Definition.- In this Act "completed investigation" shall mean the forwarding of a police report under section 173 of the Code of Criminal Procedure, 1898 (Act V of 1898), heretoafter referred to as the said Code, at the end of an investigation in repect of any offence in accordance with the provisions of the Suppression of Terrorist Offences Act, 1992 (Act No.44 of 1992), heretoafter referred to as the said Act.

3. Settlement of certain proceedings under Act No.44 of 1992.- Notwithstanding the expiry of the period of the said Act in accordance with section 1 (2) of the said Act,-

a) all cases, appeals and other necessary proceedings including additional investigations in accordance with the said Act for the purpose of deciding on any offence the investigation in respect of which under the said Act has been completed on or before the date of expiry of the period of the said Act shall be taken and completed as if the period of the said Act had not expired.
b) all cases, appeals and other necessary proceedings under the said Act pending before any Tribunal established under the said Act or any other court immediately before the expiry of the period of the said Act and all additional investigations which have not been completed and which it is necessary to complete at the investigating authorities even after the expiry of the said period shall be taken and completed as if the period of the said Act had not expired;
c) all Tribunals established under the said Act shall, for the purpose of settling cases and any other proceedings under the clauses a) and b), be maintained until they are abolished by the Government through publication in the official Gazette.
4. Completing and deciding investigations in respect of offences under Act No.44 of 1992. Where the investigation of any offence under the said Act has not been completed before the expiry of the period of the said Act, the investigation shall be completed in accordance with the provisions of the said Code; and the trial of the offence and the other proceedings for this purpose shall be conducted in accordance with the Act and before the court or tribunal in accordance with which or before which they would have been conducted had the said Act not been made.

5. Repeal and savings.- (1) The Suppression of Terrorist Offences (Special Provisions) Ordinance, 1994 (Ordinance No.5 of 1994) stands herewith repealed.
(2) Notwithstanding such repeal, all actions done or measures taken under the repealed Ordinance shall be deemed to have been done or taken under this Act.
