An Act made to repeal the Bangladesh Jute Corporation Ordinance, 1985

Whereas it is expedient for the abolishment of the Bangladesh Jute Corporation to repeal the Bangladesh Jute Corporation Ordinance, 1985 (XXX of 1985) and to provide for matters connected therewith;

Now, therefore, it is enacted as follows:-

1. Short title and commencement.- (1) This Act may be called the Bangladesh Jute Corporation (Repeal) Act, 1993.
(2) It shall be deemed to have come into force on 14th Bhadra, 1400/ 29th August, 1993, respectively.

2. Repeal of Ordinance No. XXX of 1985, etc. .- (1) The Bangladesh Jute Corporation Ordinance, 1985 (XXX of 1985), heretoafter referred to as the said Ordinance, stands herewith repealed.
(2) Upon the repeal of the said Ordinance,-

a) the Bangladesh Jute Corporation established under the said Ordinance, heretoafter referred to as the abolished Corporation, shall be dissolved;
b) all assets, rights, powers, authorities and privileges and all property, movable and immovable, cash and bank balances and all other rights and interests of the said Corporation shall vest in the Government;
c) all debts and other liabilities incurred by the dissolved Corporation before being abolished shall, subject to the provisions of clause e), be deemed to be debts and liabilities of the Government;
d) all suits and other legal proceedings instituted by or against the dissolved Corporation before its abolishment shall be deemed to have been instituted by or, as the case may be, against the Government;
e) notwithstanding anything contained in any other law, any agreement, document or service conditions, all officers and employees employed in the Corporation before its dissolution, except the officers and employees referred to in clause f), shall terminate their employment and the Government may therefore grant them such financial advantages etc. as it may determine:
Provided that the Government may, for the purpose of carrying out any particular work, appoint such number of officers and employees as it may determine under such conditions and for such period as it may determine;
f) officers and employees obliged to perform services in the dissolved Corporation, if any, shall be deemed to have been released from their duties in order to return to the institutes or authorities from which they had been compulsorily appointed.
(3) If there arises any difficulty in implementing the provisions of sub-section (2), the Government may give such directions as may be required to remove such difficulty.

3. Repeal of Ordinance No.7, 1993 etc. .- (1) The Bangladesh Jute Corporation (Repeal) Ordinance, 1993 (Ordinance No.7, 1993) stands herewith repealed.
(2) Notwithstanding such repeal, any action done or measure taken under the repealed Ordinance shall be deemed to have been done or taken under this Act.
