The following Act of Parliament received the assent of the President on 8th July, 1987

An Act made further to amend the Administrative Tribunals Act, 1980

Whereas it is expedient further to amend the Administrative Tribunals Act, 1980 (VII of 1980)
for carrying out the purposes hereinafter appearing;

Now, therefore, it is herewith enacted as follows:-
1. Short title.- This Act may be called the Administrative Tribunals (Amendment) Act, 1987.

2. Amendment of section 5 of Act VII of 1981.- In section 5 of the Administrative Tribunals
Act, 1980 (VII of 1980), heretoafter referred to as the said Act, for sub-section (2) and (3) the
following sub-sections shall be substituted, namely:-

     "(2) The Administrative Appellate Tribunal shall consist of one Chairman and two
     other members who shall be appointed by the Government.
     (3) The Chairman shall be a person who is, or has been, or is qualified to be a Judge
     of the Supreme Court, and of the two other members, one shall be a person who is
     or has been an officer in the service of the Republic not below the rank of Joint
     Secretary to the Government and the other a person who is or has been a District
     Judge.
     (4) The Chairman or any other member of the Administrative Appellate Tribunal
     shall hold office on such terms and conditions as the Government may determine."

3. Amendment of section 7 of Act VII of 1981.- In section 7 of the said Act,-

     (a) after sub-section (3) the following sub-section shall be inserted, namely:-
     "(3A) In the event of any difference of opinion among the members of the
     Administrative Appellate Tribunal, the opinion of the majority shall prevail.
     (3B) If, in the course of a hearing, the Chairman or any other member of the
     Administrative Appellate Tribunal is, for any reason, unable to attend any sirtting
     thereof, the hearing may continue before the other two members."; and

     (b) in sub-section (6), for the words "or the member" the words "or the Chairman"
     shall be substituted.
